3M, the maker of N-95 masks, has filed trademark claims against four Amazon sellers for selling 3M branded N-95 masks that are counterfeit. The defendants are KM Brothers Inc., KMJ Trading Inc., Supreme Sunshine, Inc. and Mao Yu.
With nationwide shortage of Personal Protection Equipment (PPE) the fake masks, were sold at huge markup to consumers, intentionally defrauding and misleading consumers into believing they were buying the gold standard for PPE in reducing exposure to airborne biological particles and liquid contamination.
3M sells N-95 masks for $1.27 per mask but these retailers were selling their products for up to $23.21 per mask.
With recent reports of Instacart marking up Costco products 25%, while paying minimum wage to its employees, I wonder whether Amazon is taking a cut on these mask sales and if Amazon’s is exercising any supervision over vendors, who by definition have been approved by Amazon.
I Defective Product Lawsuits Against Internet Sellers on the passing of Assembly Bill 3262, which would hold online marketplaces like Amazon to the same legal standards as traditional storefronts where issues involving dangerous and defective products are concerned.
With an excess of 15 percent of total purchases being made online, and that number increasing everyday during the pandemic, it’s more important than ever to make sure we’re holding Amazon and other online retailers accountable for unsafe, defective and dangerous products, as well as price gouging by vendors using their platform.
